A federal judge ordered the Department of Justice to pay a $2.7 million settlement over claims the government is blocking coverage of the drug industry’s Viagra.
The settlement is the first in a series of lawsuits over the so-called “little blue pill” -- or “Viagra” -- that the pharmaceutical industry and other health insurers have filed against the drugmakers.
The suit was filed Monday in the U. S. District Court for the District of New Jersey. It seeks a declaration that Viagra is covered under the Affordable Care Act, while also seeking compensation for consumers who have suffered damages because the drug is linked to the death of their loved one.
The suit alleges the Department of Justice has refused to provide coverage of the drug.
The company also filed a complaint against the pharmaceutical giant, saying the company violated federal law by denying doctors access to the drug's medical information.
The suit also alleges the companies knew or should have known about the risk of serious medical complications when they first began using the drug, as well as other health risks that the drug poses when it doesn’t work.
The drug industry has long said it is “healthy” and has said it is “safe” to prescribe it, but that it is still “getting in the way of our patients' well-being”.

In a statement, the company said: "Plaintiffs have demonstrated that the Department of Justice has been aware of the serious risks associated with the use of Viagra and has been able to respond to them promptly with a settlement that protects consumers who are taking the drug."
The company also said it was “unable to provide the necessary information” to settle the lawsuit.
“Consumers are not being warned that they are suffering immediate and serious harm, and there are no adequate resources to help them navigate this process,” the company said.
In its response, Pfizer also said it was “unable to provide the necessary information” to settle the lawsuit.
In its statement, the company said: “Pfizer and its subsidiaries have consistently failed to adequately address the risks of Viagra. This is a matter of public record.”
